Two Belarusians are currently in camps for migrants, and two are free because of court decisions. \u201cBorder guards say that Belarusians are misusing the right to asylum,\u201d the activist emphasized.<\/p>\n\n\n\n<p>\u201cThe practice of Polish border authorities has changed since late June,\u201d Ki\u015blak said. \u201cBelarusians without visas used the so-called \u2018false transit\u2019 to fly from a visa-free country, usually Georgia, to another and apply for asylum while transiting Poland.\u201d<\/p>\n\n\n\n<p>Most of those who use the \u201cfalse transit\u201d are desperate because their passports are about to expire or they could not get a visa, Ki\u015blak explained. Poland used to accept asylum requests from desperate Belarusian asylum seekers before, he stressed.<\/p>\n\n\n\n<p>\u201cNow they detain and take to court everyone, and the judges decide whether to place them in a closed camp or release them,\u201d the Belarusian human rights activist noted. Some people have already been sent to the camp. Those released must wait for courts to rule on their cases.<\/p>\n\n\n\n<p>The most recent incident occurred on August 6. The court decided against sending a Belarusian woman, who had flown to Poland from Georgia, to the camp. Ki\u015blak attributed this ruling to the fact that the woman had hired a lawyer, had documents translated into Polish and had a sister in Poland.<\/p>\n\n\n\n<p>The human rights activist said people should be aware of such incidents if they go for \u201cfalse transit.\u201d They will get out in Poland and probably be arrested for up to six months or even longer. \u201cThis seriously worsens the situation for Belarusians,\u201d he stated.<\/p>\n\n\n\n<p>Ki\u015blak noted that \u201cfalse transit\u201d is illegal, but sometimes people swim across rivers to flee Belarus. Now, Belarusians are leaving Georgia due to the worsening human rights situation there and denials of asylum requests.<\/p>\n\n\n\n<p>The Belarusian human rights activist also described the typical route for the \u201cfalse transit.\u201d \u201cIf there is a valid passport that has not expired, Belarusians can fly from a visa-free country, Georgia, to another visa-free country, such as Montenegro or Serbia.\u201d \u201cIf you transit a European country, they will transfer at one airport\u00ad\u2014for example, in Poland\u2014for no more than four hours. Under the regulations, you may fly in transit without a visa.
