June 5, Pozirk.<\/em><\/strong> The human rights situation in Belarus continues to deteriorate. <\/p>\n\n\n\n

Citizens inside and outside the country are subjected to political repression, the United Nations’ special rapporteur on the human rights in Belarus, Ana\u00efs Marin, said<\/a> in her new report.<\/p>\n\n\n\n

The situation remains “extremely preoccupying” and requires the Human Rights Council’s sustained attention, she said.<\/p>\n\n\n\n

She reiterated the recommendations from her previous reports and advised the Belarusian government to begin “prompt, effective, impartial and transparent investigations into all deaths in custody.”<\/p>\n\n\n\n

Marin called on Minsk to “put an immediate end to and promptly and effectively investigate all alleged cases of ill-treatment in detention, with a view to prosecuting and punishing the perpetrators and providing redress to the victims.”<\/p>\n\n\n\n

In her opinion, Article 411 of the Criminal Code (malicious disobedience to prison authorities), which justices use to extend sentences for political prisoners, should be repealed. “Put an end to the practice of interference with the private life of former inmates under the guise of ‘preventive’ activities,” she added.<\/p>\n\n\n\n

Marin noted that the human rights situation deteriorated as Belarus entered the new electoral cycle.<\/p>\n\n\n\n

The report mentioned infringement of the right to freedom of association and pointed to “a targeted eradication of all independent associations in Belarus since 2021,” including civil society initiatives, political parties, trade unions, bar associations and religious organizations.<\/p>\n\n\n\n

The special rapporteur said that “loss of life occurring in custody, in unnatural circumstances, creates a presumption of arbitrary deprivation of life by State authorities, in violation of article 6 of the International Covenant on Civil and Political Rights.” “Such presumption can only be rebutted on the basis of a proper investigation,” Marin added.<\/p>\n\n\n\n

The document also covered the situation of the Belarusian language, which is “increasingly perceived as a sign of political disloyalty and is being abandoned in favour of Russian in the public administration, education, culture and the mass media, upon orders from the hierarchy or out of fear of discrimination.” Literature in the Belarusian language has reportedly been confiscated from penitentiary institutions, and Belarusian-speaking prisoners are subject to harsher treatment.<\/p>\n\n\n\n

Marin described the bill presented in February 2024 by Prosecutor General Andrej \u0160vied as “targeting women and LGBTQ+ persons.” The bill provides for administrative liability for “propaganda for non-traditional family relations,” including “propaganda for abnormal relations, paedophilia and voluntary refusal of childbirth.”<\/p>\n\n\n\n

“The Special Rapporteur condemns this initiative as contrary to the right to freedom of expression (art. 19 of the International Covenant on Civil and Political Rights) and the right to privacy (art. 17 of the Covenant) and deplores the fact that it may lead to discrimination in violation of article 26 of the Covenant,” the report reads.<\/p>\n\n\n\n

The mandate of the special rapporteur on human rights in Belarus was established in 2012 and has been renewed annually. Ana\u00efs Marin, from France, has been serving in this capacity since November 2018.<\/p>\n\n\n\n
