July 4, Pozirk.<\/em><\/strong> The European Union has denied the protection of the Energy Charter Treaty to investors from Belarus and Russia, the EU’s Directorate\u2011General for Trade reported<\/a> yesterday.<\/p>\n\n\n\n

Earlier, the EU introduced sanctions against Minsk and Moscow, including a ban on transactions with Belarusian and Russian investors. The ban on ECT protection is intended to preemptively deprive them of a potential means of challenging these sanctions.<\/p>\n\n\n\n

The EU has noted that neither Minsk nor Moscow are parties to the ECT. However, Belarusian and Russian investors could theoretically use companies in the ECT countries to declare that the EU or its members have violated their own investment protection obligations under the treaty and initiate investor-state dispute settlement proceedings.<\/p>\n\n\n\n

The denial of protection to Russian and Belarusian investors ensures that such claims cannot be reasonably brought, it said.<\/p>\n\n\n\n

The ECT is an international agreement in the energy sector. It concerns investment protection, trade and transit of energy resources, and dispute settlement. The EU is a party to the ECT, but is in the process of withdrawing from it. However, it will be required to continue to apply the ECT to existing investments for decades to come.<\/p>\n\n\n\n

In March, the European Commission proposed denying ECT protection to Russian and Belarusian investments. The Council of the European Union passed the corresponding decision a month later.<\/p>\n\n\n\n
