If the other branches can theoretically counterbalance each over, the assembly would be above the other branches, she noted.\n<\/p>\n<p>\n\t Vadzim Ipata\u016d, director of Belarus\u2019 National Center for Law Drafting and Legal Studies, described the assembly as \u201ca representative body to be formed of all branches of power, civil society representatives, a rather large number of people elected as a result electoral campaigns.\u201d\n<\/p>\n<h2> <span>Selection mechanism is a mystery<\/span> <\/h2>\n<p>\n\t Meanwhile, the mechanism to select delegates to the assembly remains unclear, said Piotr Piatro\u016dski, a political analyst affiliated with the Bielaja Rus association of Aliaksandr Luka\u0161enka supporters in his Telegram post.\n<\/p>\n<p>\n\t The assembly is to include the incumbent and his predecessor, lawmakers, executive government officials, judges, members of local soviets (elected councils) and civil society representatives, says Article 892 of the draft.\n<\/p>\n<p>\n\t Another clause says that a separate law is to be adopted to outline the procedure for delegating representatives of local soviets and civil society. It is unclear how delegates from other branches of power would be selected.\n<\/p>\n<p>\n\t The lack of clarity proves that Luka\u0161enka does not plan to rebuild the political system in the next two or three years.\n<\/p>\n<p>\n\t The government published the draft on December 27, the day before the Belarusian leader left for Moscow for talks with Vladimir Putin.\n<\/p>\n<p>\n\t The draft calls for the redistribution of powers among the branches and would annul the president\u2019s power to rule by decree. However, the presidency would remain powerful anyway, although the All-Belarusian People\u2019s Assembly would oversee it.\n<\/p>\n<h2> <span>Luka\u0161enka delays political reform<\/span> <\/h2>\n<p>\n\t The new constitution may establish two centers of power; both may be controlled by Luka\u0161enka.\n<\/p>\n<p>\n\t The draft says that delegates are not required to quit their permanent jobs to sit at the assembly, which is to convene at least once a year. The assembly\u2019s Presidium would be a permanent body.\n<\/p>\n<p>\n\t The new constitution would give Luka\u0161enka immunity from prosecution on his departure from the current office, as well as seats on upper house of the Belarusian National Assembly and on the All-Belarusian People\u2019s Assembly. However, he seems to be reluctant to step down for fear of losing control.\n<\/p>\n<p>\n\t The constitutional referendum would be followed by a transition period that may take several years.
